These Terms of Service (“Terms”) govern your use of livoratech.shop and purchases from LivoraTech. LivoraTech is operated by CHELLE SoftTech LLC.
By visiting the store, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference.
1. Eligibility
You must be at least the age of majority in your place of residence, or use the store with the involvement and permission of a parent or legal guardian.
You may not use the store for unlawful, fraudulent, abusive, or unauthorized purposes.
2. Store services
We operate an online store offering lower-cost consumer electronics, watches, accessories, smart-living products, and utility devices.
Some products are supplied and shipped by independent international fulfillment partners, including partners located in China.
3. Product information
We try to provide accurate product titles, descriptions, specifications, images, dimensions, colors, compatibility information, and package contents.
However:
• Screen settings may affect color appearance;
• Minor packaging or design updates may occur;
• Measurements may have reasonable tolerances;
• Product interfaces may differ by software version;
• Accessories shown for illustration are included only when stated; and
• Product compatibility depends on the customer’s device, operating system, network, voltage, plug type, and intended use.
You are responsible for reviewing the product page before purchase and confirming compatibility.
4. Prices, taxes, and errors
Prices are displayed in the currency shown at checkout and may change without notice.
Applicable taxes, shipping charges, and other fees are displayed at checkout when available.
We may correct typographical, pricing, inventory, specification, or promotional errors. If a material error affects an order, we may contact you for instructions or cancel and refund the affected item.
5. Order acceptance
An order confirmation means that we received your order. It does not guarantee acceptance.
We may refuse, limit, cancel, or review an order for reasons including:
• Product unavailability;
• Pricing or listing errors;
• Suspected fraud or unauthorized payment;
• Resale activity;
• Delivery restrictions;
• Supplier limitations;
• Compliance concerns; or
• Violation of these Terms.
If we cancel a paid order, we will refund the amount charged for the canceled item.
6. Payment
You agree to provide current, complete, and accurate billing and payment information.
Payments are processed by Shopify Payments or other payment providers available at checkout. Your use of a payment method may also be subject to the provider’s terms.
7. Shipping and delivery
Processing, fulfillment, tracking, and estimated delivery are governed by our Shipping Policy.
Delivery estimates are not guaranteed arrival dates. International fulfillment may involve customs processing, carrier transfers, and separate packages.
8. Returns, refunds, and cancellations
Returns, refunds, damaged items, cancellations, and exchanges are governed by our Return and Refund Policy.
Do not send a product to our legal mailing address or the address on the original shipping label without return authorization.
9. Product use and safety
You must follow all instructions, warnings, charging requirements, voltage requirements, installation guidance, and safety information supplied with the product.
Do not use a product if it:
• Is damaged, swollen, leaking, overheating, sparking, or producing an unusual odor;
• Has a damaged battery or cable;
• Has been exposed to incompatible voltage or liquid; or
• Appears unsafe.
Disconnect the product and contact us when appropriate.
Products sold by LivoraTech are not intended for medical, emergency, life-support, industrial safety, or other safety-critical use unless the product page expressly states otherwise.
10. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
Notify us at support@livoratech.shop if you suspect unauthorized account access.
We may suspend or terminate an account used for fraud, abuse, threats, harassment, chargeback misuse, or violations of these Terms.
11. Reviews and user content
If you submit a review, photo, video, comment, or other content, you confirm that:
• You have the right to submit it;
• It is truthful and relates to your actual experience;
• It does not violate another person’s rights;
• It does not contain unlawful, defamatory, threatening, obscene, or malicious content; and
• It does not contain malware, spam, or deceptive advertising.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute submitted content in connection with operating and promoting the store, subject to applicable law and our Privacy Policy.
We may moderate or remove content that violates these Terms.
12. Intellectual property
The store, brand name, logos, text, graphics, layout, product presentation, and original content are owned by or licensed to CHELLE SoftTech LLC and are protected by applicable intellectual property laws.
You may not copy, reproduce, scrape, republish, modify, distribute, or commercially exploit store content without permission, except as allowed by law.
13. Prohibited uses
You may not:
• Use the store for unlawful or fraudulent activity;
• Submit false information;
• Attempt unauthorized access;
• Introduce malware or harmful code;
• Scrape or harvest data without authorization;
• Interfere with security or store operation;
• Impersonate another person;
• Infringe intellectual property or privacy rights;
• Submit fraudulent disputes or chargebacks;
• Abuse promotions or return procedures; or
• Use products for prohibited or unsafe purposes.
14. Third-party services and links
The store may use or link to third-party services. We do not control every third-party service and are not responsible for its independent content, availability, policies, or practices.
Use third-party services at your own discretion and review their terms and privacy notices.
15. Disclaimer of warranties
To the fullest extent permitted by law, the store and services are provided on an “as available” basis.
We do not guarantee uninterrupted access, error-free operation, or that every product will meet every personal preference or third-party compatibility requirement.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
16. Limitation of liability
To the fullest extent permitted by law, CHELLE SoftTech LLC, LivoraTech, and their service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, or loss of use, arising from use of the store or a product.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless CHELLE SoftTech LLC, LivoraTech, and their service providers from claims, losses, and reasonable expenses arising from your unlawful use of the store, violation of these Terms, or infringement of another person’s rights.
18. Governing law
These Terms are governed by the laws of the State of South Dakota and applicable federal law, without removing any mandatory consumer protections available to you in your place of residence.
19. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
20. No waiver
Failure to enforce a provision does not waive the right to enforce it later.
21. Entire agreement
These Terms, together with the policies referenced on the store, form the agreement between you and us regarding the store and purchases.
22. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless otherwise required by law.
